The Booking |

Please note that your booking is with Chirlaks Enterprises and its existence comes into force between us from the moment we have confirmed you on the tour of your choice; we have received your signed reservation form; and we have received the deposits against the booking. The reservation form should be duly signed by you as a token of acceptance of our booking terms and conditions before submitting to us. No unsigned reservation form can be accepted for booking. |

| 2. |
Adance Deposit |
| |
Upon submission of a reservation form duly signed by you, an advance deposit of 25% of the cost of tour, per person, has to be paid to our company and proof of such remittance to be faxed or emailed to us thereafter. |

| 3. |
Balance Payment |
| |
Balance payment must be paid 30 days prior to the tour date. Failure to pay the balance within the specified period shall result in cancellation of the booking and in payment of a cancellation fee as per details given below. |

| 4. |
Mode of Payment |
| |
Payments can be made to us by cash, cheque, Demand Draft, Credit Card or Electronic Money Transfer. If it is by an outstation cheque a nominal clearing charge will be levied. If the payment is made by credit card a surchage of 3% will be levied. For reservation made within 15 working days of the proposed tour departure, the full amount of such tour cost must be paid in advance. |

Changes in Reservations |
| |
Changes such as date of departure, accommodation etc, if any, wish to be changed in your tour packages after a confirmation invoice has been issued will be given due attention and we shall do our utmost to give you maximum satisfaction. However, it may not always be possible. |

| 6. |
Cancellation Policy |
| |
Cancellation of a confirmed booking, if any, must be notified to us in writing. The notice of cancellation must be signed by the same person who has signed the reservation form. The date of cancellation of the booking will be the date of receipt of the cancellation notice by us in our company. The cancellation charges will be applied as detailed below in view of the administrative cost and the retention charges levied by the hotels. |

| 7. |
Liability |
| |
We, Chirlaks Enterprises, do not own or control hotels, resorts, spas, house boats, homestays, coaches or any such facilities mentioned in our tour packages. We, therefore, as an operator of the package tour or individual reservation of your stay, cannot be held liable for the failures in performance of the contract due to the following reasons: |
| a) |
If there has been no fault on the part of Chirlaks Enterprises, the supplier or the agents. |
| b) |
If the failure of the contract performance is attributable to the customer. |
| c) |
If the failure in performance is due to unforeseeable and unavoidable circumstances beyond our control. |
| d) |
If the failure in performance is due to unforeseeable and unavoidable circumstances which are beyond your control. |
| e) |
If the failure is due to any event which you or your supplier or the agents cannot foresee or foretell even with due care. |
| f) |
However, we shall endeavour our best to take all reasonable measures to provide our esteemed guests a very pleasant and memorable holiday experience from the tour packages organized by us. We shall also make sure that we maintain all best standards with reasonable care that are acceptable to our guests. |

| 8. |
Right to amend the tour itinerary, if required. |
| |
Tours once booked and confirmed will be conducted strictly as per the itinerary finalized in the contract. However, in the event of circumstances beyond our control, we reserve the right to amend all or part of the itinerary for the safety and well being of our esteemed guests. |

| 9. |
Surchage |
| |
All our rates for the travel arrangements are subject to surcharges in case of sudden hikes in fuel prices, surcharge in airfare and any taxes levied by the government. |

| 10. |
Extra Expenses |
| |
Any additional expense incurred during the itinerary other than those mentioned in the tour packages will be considered as Extra Expenses and such expenses are to be paid by the guests directly and such payments have to be settled immediately or before the departure. |

| 11. |
Complaints |
| |
We shall do our best to give our esteemed guests an enjoyable and trouble free holiday. In case any thing goes wrong during the itinerary, kindly inform our representative who will do everything possible to resolve the matter immediately. If the matter is not resolved to your satisfaction, you may please contact Chirlaks Enterprises by phone, fax or email and we shall do our best to help you solve the situation. In case of any matter which has not been resolved to your satisfaction which you wanted to inform us later, must be notified to us in writing within 20 days of the tour ending failing which it will affect the investigation and the outcome of the complaint. Any dispute between the clients and Chirlaks Enterprises shall be governed the Jurisdiction of India. |

| 12. |
Travel Rules - Passport, Visa and Health. |
| |
Any foreign national traveling to India except for the citizen of Nepal and Bhutan, needs a 6 (Six) months valid passport with valid visa. Any passenger traveling to India without proper document will be deported. Please note that processing charges for passport and visa are not included in our tour packages. |

Similarly, any person with contagious diseases is forbidden to travel. Hence, any person found with such diseases during the tour will be asked to leave the tour and will have to make his own arrangements to return home. |

| 13. |
Early Check-in / Late Check-out |
| |
Since all good hotels are following standard check-in and check-out time at 1200 Hrs (IST), early check-in and check-out cost is not included in our tour packages. We shall always request the concerned hotels for early check-in / check-out wherever required. However, we do not guarantee that as it is entirely depending on the policy of the hotel, time schedule of the year and the availability of the room. |

General |

Please note the terms and conditions will vary depending on the type of packages requested by or offered to our clients. Hence, the terms and conditions stipulated herein are general terms and conditions. Any additional terms and conditions, if required according to the type of packages, will be as per the terms and conditions stipulated in the tour package contract. |

We use the information you provide about yourself when requesting a travel reservation to complete that request. We do not share this information with outside parties except to the extent necessary to complete that order.
We use the information you provide about someone else when referring a friend only to provide the information you have requested. We do not share this information with outside parties except to the extent necessary to complete that request.
We use return email addresses to answer the email we receive. Such addresses are not used for any other purpose and are not shared with outside parties.
We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses. |

Our Liability |
| |
We, Chirlaks Enterprises, are liable for those arrangements of your holiday which are wholly within our control which includes our employees, except for the following circumstances which are beyond our direct control.
Chirlaks Enterprises shall, in no circumstances and whatsoever, be liable to the client or any person traveling with him / her during the itinerary of the tour package for any death, personal injury, sickness accidents, loss, delay, discomfort, increased expenses, consequential loss and / or damage or theft howsoever caused; and / or Any act, omission, default of any independent contractor or other person or by any servant or agents employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the client or for any person traveling with him / her howsoever caused.
Chirlaks Enterprises shall also not be liable for commercial arrangements in situations beyond our control such as natural disasters, industrial disputes, reason of threat or war, riots, civil strike, terrorist activities, technical problems to the transport, extreme weather conditions, closure of the airports and sea ports and similar events which are out of our control or are due to unforeseen or unusual circumstances beyond our control. |
